Terms and Conditions
Please note to be eligible for the 2024 Seed Treatment Credit program you must have an active BASF credit account.
PURPOSE: This agreement sets out the process by which RETAILERS who recommend and sell Triazine Tolerant and Clearfield canola varieties *excludes stacked varieties (LT, TC, CT, XC and XT) with BASF seed treatments , ILeVO and Poncho Plus, will earn BASF credits. For every treated 20kg (bag) of Triazine Tolerant and Clearfield canola varieties sold *excludes stacked varieties (LT, TC, CT, XC and XT), you will receive: $4 BASF credit when treated with ILeVO. $6 BASF store credit when treated with ILeVO & Poncho Plus.
1. Term and payment
(a) Eligible sales of seed treated with BASF Seed Treatment Products from 1 September 2024 to 30 April 2025 will qualify for an account credit. Only purchases made during this period are eligible.
(b) Calculation of the credit is based on total volumes (by 20kg) purchased by each individual RETAILER. 
(c) The credit is earned after the RETAILER submits all the purchase invoices with the supporting documentation to Bonus bucks are in the bag! | BASF Crop Solutions Australia. Failure to provide proof of purchase will invalidate the claim for the loyalty reward. Provided correct documentation acceptable to BASF has been received, payments will be processed within 90 days after 30 June 2025.
(d) If this Agreement is terminated by BASF, the RETAILER acknowledges that there shall be no entitlement to any loyalty payment on a pro-rated basis.
2. Confidential information
This Agreement, and all of its terms, as well as any other information designated confidential and disclosed by BASF to the RETAILER will be kept in confidence except where the RETAILER can show the information has become public information (other than by a breach of this Agreement)  or which may be required to be disclosed by law.
3. Governing law; other terms
a) This Agreement shall be governed by the laws of the State where the Agreement is entered into.
b) The parties submit to the exclusive jurisdiction of the courts of that State in respect of all disputes or matters arising from this Agreement.
c) Failure of either party to exercise any right it has under the Agreement shall not be construed as a waiver by such party of its right to exercise the same right later.
d) Any waiver must be in a writing signed by the waiving party.
e) If any provision of the Agreement shall be adjudicated to be invalid or unenforceable, it is the parties’ intent that the remaining provisions of the Agreement will remain in full force and effect, and the affected provision or portion will be deemed modified so that it is enforceable to the maximum extent permissible to reflect as closely as possible the intentions of the parties.
f) BASF reserves the right, in its sole discretion, to modify or withdraw any or all of the terms and conditions of this Program if required by law or if BASF otherwise considers necessary.
g) BASF reserves the right to access records, books and documents of the RETAILER for the purposes of auditing all claims for loyalty payments and reserves the right to make, in its sole discretion, a final decision that is binding on both parties in respect of payments under this Agreement.
